Dear APPEC Supporters,

The ERT met briefly Monday (via teleconference) with the Parties in the appeal of the White Pines wind project to discuss next steps in the proceedings.  Following the Tribunal’s finding of serious and irreversible harm to Little Brown Bats and to the Blanding’s turtle WPD will be attempting to provide new evidence that they can come up with mitigation measures or “remedies” for the serious environmental damage their project will cause.

The currently proposed schedule has WPD submitting a remedy plan to the Tribunal by the end of April.  Responses from the appellants, APPEC and John Hirsch, would be expected a month later, at the end of May.   If this timetable is acceptable to all of the Parties the hearing would tentatively take place in late June / early July. 

The Tribunal has extended the adjournment until the next hearing date, which is expected to be near the end of March, in order to give APPEC legal counsel Eric Gillespie sufficient time to consider this schedule. 

When asked by Mr. Gillespie if the Tribunal could give some indication on when to expect a decision on APPEC’s stay motion, Marcia Valiante said that it would be coming shortly.
